RENTAL TERMS AND CONDITIONS FOR LONG STAY
Fundamental Legal Requirements
- Identification: It is mandatory for tenants to provide identification (National ID, Passport, or Certified Student ID) before entering an agreement.
- Written Agreements: Any tenancy with rent exceeding UGX 500,000 must be in writing to be legally enforceable.
- Rent Payments: All rent must be settled in Uganda Shillings unless both parties expressly agree to a different currency in the contract.
- Payment Receipts: Receipts shall be issued at the successful processing of payment.
Rent and Security Deposits
- Advance Rent: Landlords cannot require more than three months' rent in advance for tenancies longer than one month, unless the tenant voluntarily agrees to pay more.
- Security Deposit: A landlord may only charge one security deposit, which cannot exceed one month’s rent.
- Rent Increases: Landlords must provide at least 60 days' notice before any increase takes effect.
Maintenance and Utility Responsibilities
- Fitness for Habitation: Residential premises must be fit for human habitation, meaning they meet standards for natural lighting, ventilation, water supply, and sanitation.
- Repairs: Landlords are responsible for maintaining the exterior and common areas in good repair. Tenants are liable for damages caused by their own negligence.
- Urgent Repairs: If a tenant handles urgent repairs (e.g., burst pipes, dangerous electrical faults), the landlord must reimburse them within 14 days.
- Utilities: Tenants are generally liable for electricity and water if the premises are separately metered. Landlords are liable for charges at premises that are not separately metered.
Termination and Eviction
- Notice Periods: Standard notice for a monthly residential tenancy is 30 days.
- Eviction for Non-payment: If rent is in arrears for more than 30 days, the landlord may re-enter and take possession of the premises, provided this notice was indicated within the portal and officiated by the local LC1 chairperson, if needed landlord may escalate this matter to the police.
- Abandonment: A tenancy is considered abandoned if the tenant is absent for 30 consecutive days without notice and rent is unpaid.
